User Agreement and Copyright Notice

1. The Kentucky State Council, Knights of Columbus (hereafter referred to as the KY KofC State Council) website is accessible worldwide to anyone with Internet access. Access to and use of the Service and the Sites are subject to the terms and conditions of this User Agreement and Copyright Notice and all applicable laws and regulations, including laws and regulations governing copyright and trademark. BY ACCESSING THE SERVICE AND THE SITES, YOU ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, ALL OF THE TERMS AND CONDITIONS IN THIS USER AGREEMENT. The KY KofC State Council and the Knights of Columbus reserve the right to change these terms and conditions at any time. The changes will appear on this screen. By using the Service and the Sites, you agree in advance to accept any changes.
2. The materials used and displayed on the Service and the Sites, including but not limited to text, software, photographs, graphics, illustrations and artwork, video, music and sound, and names, logos, trademarks and service marks, are the property of the Knights of Columbus or its affiliates or licensors and are protected by copyright, trademark and other laws. Any such content may be displayed solely for your personal, non-commercial use. You agree not to modify, reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any such material without the written permission of the KY KofC State Council, Knights of Columbus or the appropriate affiliate.
3. Your use of the Service and the Site is at your own risk. Neither the KY KofC State Council, Knights of Columbus nor any of its subsidiaries, divisions, affiliates, agents, representatives or licensors shall be liable to you or anyone else for any loss or injury or any direct, indirect, incidental, consequential, special, punitive or similar damages arising out of your access or use of, or your inability to access or use, the service and the sites and the information available on the service and the sites or arising out of any action taken in response to or as a result of any information available on the service and the sites. You hereby waive any and all claims against the KY KofC State Council, Knights of Columbus and its subsidiaries, divisions, affiliates, agents, representatives and licensors arising out of your use of the service and the sites and the information available thereon.
4. Any material which is downloaded or otherwise copied and/or reproduced in any manner from this Server for or on behalf of the United States of America, its agencies, instrumentalities and/or employees acting in its behalf ("The United States"), is provided with Restricted Rights. Duplication, disclosure and/or use in any other manner by the United States is subject to all restrictions stated and set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted Rights at 48 CFR 52.227-19, as applicable.
5. Disclaimer regarding information accessed via KY KofC State Council Portal.  The KY KofC State Council expressly disclaims any representation, warranty or responsibility in relation to any information, goods or services offered, accessed or obtained through the KY KofC State Council Portal; the operation or quality of KY KofC State Council Portal, whether KY KofC State Council Portal will be uninterrupted or error free; any obligation to maintain the confidentiality of information (although the KY KofC State Council's current practice is to maintain such confidentiality where reasonable to do so); or the results to be obtained from use of KY KofC State Council Portal. To the extent permitted by law, the KY KofC State Council expressly disclaims any warranties, whether expressed or implied, as to the fitness for a particular purpose, merchantability or standard of quality of KY KofC State Council Portal and any such information, goods or services offered, accessed or obtained through KY KofC State Council Portal. 
6. The Knights of Columbus, any of its subsidiaries, divisions, affiliates, agents, representatives or licensors will under no circumstances be liable for any direct, indirect, incidental or special loss or damage, whether arising from negligence, breach of contract, defamation, infringement of copyright or other intellectual property rights, caused by any use of site Portal (including any such loss or damage caused by viruses), whether or not notified of such damage or loss arising.
